Generative AI exclusion on updated umbrella and excess forms

Generative Artificial Intelligence Exclusion (umbrella and excess)

What it does

The exclusion applied one layer up. An umbrella or excess policy that carries a generative AI exclusion will not follow the primary policy's coverage for a generative AI claim even where the primary has no such exclusion, so the two forms have to be read together. For a robotics or AI company whose customer contract requires a $5M umbrella, an exclusion on the umbrella can leave the contractually required limit unavailable for exactly the claim the customer worried about.

Where it applies

Washington: the source reports the filer updated its commercial umbrella and excess forms there. Other states not stated.

This page describes coverage in general terms. It is not an offer of insurance, and carrier appetite, policy wording, licensing, and availability govern every quote and every claim.
